These Terms and Conditions govern the online sale of products offered through the website www.vestopazzo.it (“Website”) by:

The buyer (“Customer”) must be a natural person acting for purposes outside any business, trade, craft or profession. Purchases are only permitted for adults with full legal capacity.

These Terms and Conditions govern the online purchase of the products displayed on the Website (“Products”).
The contract is entered into remotely pursuant to Articles 45-67 of Italian Legislative Decree 206/2005 (Consumer Code) and Italian Legislative Decree 70/2003 (e-commerce).

The display of Products on the Website is an invitation for the Customer to place an order.

To complete the purchase, the Customer must:

1. fill in the online order form,
2. agree to these Terms and Conditions,
3. send the order by clicking on the appropriate button.

Vestopazzo will send an order confirmation by e-mail containing a summary of the Products, prices, shipping costs, payment methods and order number.
The contract is concluded on receipt of the order confirmation.

The applicable Terms and Conditions are those in force on the date of the order.

The purchase can be made with or without registration.
Registration allows customers to:

• consult their order history,
• speed up future purchases,
• manage delivery addresses,
• access the after-sales service,
• save a wishlist,
• join the loyalty programme (where applicable).

The Customer guarantees that the data provided is true and up to date.

Availability is indicated on the Website and is automatically updated.
If a product is unavailable, Vestopazzo will inform the Customer and:

• promptly refund the amounts paid, or
• propose an alternative, if desired.

Each Product is described on a technical data sheet.
The images are illustrative; colours and textures may vary depending on the devices used.

The description on the order form is accurate.

Prices are in Euros and include VAT.
Shipments and additional services are indicated separately before confirmation.

Any duties, local taxes and customs charges for deliveries outside Italy are payable by the Customer.

If the Customer is a member of the loyalty program, they can use discounts or points as provided for by the regulations.

The following payment methods are accepted:

• credit/debit cards,
• PayPal,
• Vestopazzo Gift Card,
• other methods specified at checkout.

Card details are not stored by Vestopazzo.

If an order is cancelled, Vestopazzo will request the release of any authorised amounts. Any delay by the bank is not attributable to the Seller.

Vestopazzo may conduct anti-fraud checks.

Delivery is made by courier to the address specified by the Customer.
The Customer will receive the tax document by e-mail.

Approximate times: 2–6 working days (except for remote areas or due to force majeure).

At the time of delivery, the Customer must verify:

• the integrity of the packaging,
• the number of parcels.

Any damage or irregularities must be reported with a specific reservation on the courier’s handheld terminal.

Failure to add a specific reservation limits the ability to claim against the courier.

In the event of storage due to the absence of the recipient, after unsuccessful attempts the package may be returned to the sender; Vestopazzo will refund the amount after deducting shipping, return and storage costs.

Accepting delivery of the Product is a contractual obligation.Failure to deliver due to an incorrect address, repeated absence or refusal to accept delivery will result in termination of the contract and the withholding of any expenses incurred.

The Customer may cancel their order within 30 days of delivery without giving a reason.

To exercise this right, a request should be sent via one of the following:

• the account area on the Website, or
• the online returns form on the Website, or
• a written notice by e-mail.

The Products must be returned:

• intact,
• unwashed,
• undamaged,
• with tags/security seals attached,
• in the original packaging.

Products ordered at the same time must be returned together.

The costs of returning the goods are payable by the Customer.

Vestopazzo will refund the price paid within 14 days of receipt of the valid return.
The refund will be made using the same payment method used for the purchase.

Our products are covered by the legal guarantee of conformity under Articles 128–135 of the Italian Consumer Code, valid for 2 years from delivery.

The Customer must communicate the defect:

• within 2 months of discovery,
• by sending a description and photos.

Vestopazzo will evaluate the case and may authorise the return.

This excludes defects resulting from:

• improper use,
• natural wear and tear,
• contact with inappropriate substances,
• failure to comply with instructions.

If the non-conformity is confirmed, the Customer has the right to:

• repair or replacement,
  or, if impossible or not cost effective,
• a price reduction or contract termination with refund.

Vestopazzo is not responsible for:

• delays or non-delivery due to force majeure,
• improper or non-conforming use of the product,
• tampering by the Customer,
• indirect or consequential damages.

Gift Cards can be used as credit for purchases on the Website.

Points, benefits and expiries are governed by the regulations available on the Website.

Trademarks, logos, images, texts and distinctive marks on the Website are the exclusive property of Vestopazzo or its licensors.
Any unauthorized use is prohibited.

Personal data is processed by Vestopazzo in compliance with EU Regulation 679/2016 (GDPR).
The full privacy policy is available in the “Privacy Policy” section of the Website.

The consumer can use the European ODR platform available at the link: https://ec.europa.eu/consumers/odr/

The Website and these Terms and Conditions may be translated into several languages to facilitate consultation by users.
In the event of conflicts, differences, discrepancies in interpretation or doubts between the Italian version and any translated version, the Italian version will always and exclusively prevail as the only authentic version for legal and contractual purposes.
The contract is concluded in Italian.

These Terms and Conditions are governed by Italian law.For consumers, the place of jurisdiction is the court of the Customer’s place of residence or domicile.

Vestopazzo may modify these Terms Conditions; the new versions apply to any orders placed after publication.

Terms, conditions and exclusions – Online promotion

“Buy 4 items: the cheapest one is 50% off”

1. Validity period

The promotion, which is already live on the Vestopazzo e-commerce platform, is extended until 31 August 2026 inclusive, subject to any changes or suspension notified in accordance with clause 8.

For the purposes of applying the promotion, the date and time of order completion on the website shall be taken as the relevant time. Orders must be correctly submitted by 23:59 on 31 August 2026.

Orders that are incomplete, cancelled or associated with unauthorised or failed payments do not qualify for the promotion.

2. Scope of application

The promotion is valid exclusively on the official Vestopazzo e-commerce website and on the national versions of the website where the promotion is expressly advertised.

• The promotion does not apply at Vestopazzo physical retail outlets.
• Online purchases cannot be combined with purchases made at retail outlets.
• It is not permitted to combine items from different online orders, even if placed by the same customer on the same day.
• Any territorial exclusions or those relating to specific national versions of the website will be communicated via Vestopazzo’s official channels.

3. How the promotion works

When purchasing four items eligible for the promotion at the standard price in a single order, the customer receives a 50% discount on the cheapest item among those eligible for the promotion.

The promotion applies to complete multiples of four items:

• 4 items → 50% discount on the cheapest item;
• 8 eligible items → 50% discount on the two cheapest items;
• for larger quantities, a 50% discount is applied to one additional item for every complete multiple of four eligible items purchased.

Items exceeding a complete multiple of four do not qualify for further discounts.

The discount is automatically applied in the shopping basket to the cheapest items among those eligible for the promotion.

4. Combination with sales

The promotion cannot be combined with sales or with other price reductions applied to the same items, unless otherwise expressly stated on the website.

• Items on sale, already discounted or part of other non-combineable promotions do not count towards the minimum requirement of four items.
• Items on sale may be purchased within the same order, but will be excluded from the promotion calculation.
• Any promotional codes, coupons, discount vouchers or other offers may only be combined where this is expressly stated on the website.
• Should a code or another incompatible promotion be applied, the system may prevent the combination or apply only one of the available benefits.

5. Calculation of the discount

For the purposes of applying the promotion, only the following items are taken into account:

• those expressly included in the promotion;
• sold at the standard price;
• available on the website;
• correctly added to the same order;
• recognised by the e-commerce system as eligible for the promotion.

The 50% discount is calculated on the sale price of the cheapest item among those eligible for the promotion.

• Where several items have the same price, the system will automatically identify the item to which the discount is to be formally applied.
• The choice between items of equal price does not alter the total value of the discount granted.
• It is not permitted to combine items purchased via different orders.
• The purchase or top-up of gift cards does not count towards the minimum requirement of four items.
• Using a gift card as a payment method does not prevent the promotion from being applied.
• Delivery charges, gift wrapping, services and any additional costs do not count towards the minimum number of items required.
• The mere presence of an item on the website does not automatically mean it is included in the promotion.

Customers are advised to check that the discount has been correctly applied in their basket before completing their order.

6. Cancellation, returns and non-compliant products

Purchases made as part of this promotion are subject to the general terms and conditions of sale and the returns policy applicable to the e-commerce site, without prejudice to the mandatory rights granted to consumers under applicable legislation.

The application of the promotion does not limit the consumer’s right of withdrawal.

In the event of withdrawal or return of the entire order, the customer will receive a refund of the amount actually paid, in accordance with the terms and conditions set out in the general terms and conditions of sale.

In the event of withdrawal, return or partial cancellation of the order:

• the promotion will be recalculated on the basis of the eligible items actually retained by the customer;
• if the number of items retained falls below four, the conditions for applying the discount will no longer be met;
• if the number of items retained results in fewer than four complete multiples of four, the number of discounts will be recalculated accordingly;
• the amount to be refunded will be calculated taking into account the new total value of the order following the recalculation of the promotion.

This recalculation does not constitute a penalty, but serves solely to determine the price actually due for the items retained by the customer.

Should one or more items prove to be unavailable after the order has been placed, the promotion will be recalculated on the basis of the items actually supplied. The customer will be informed of any change to the discount and of the new order total.

The consumer’s rights in the event of a defective or non-compliant product remain fully unaffected. The application of the discount does not limit the remedies provided for under the statutory guarantee of conformity.

7. Restrictions

The promotion:

• is not retroactive;
• is valid exclusively on the e-commerce website and during the specified period;
• applies exclusively to products included in the promotion;
• it applies only when the minimum number of items is reached within a single order;
• it does not allow different orders to be combined;
• it does not allow online purchases to be combined with purchases made in-store;
• it does not apply to sale items, items already discounted or items included in other non-cumulative promotions;
• it does not generate change, credit or vouchers;
• it is not convertible into cash;
• it is not transferable separately from the order.

Vestopazzo reserves the right not to recognise or to cancel the promotional benefit in the event of fraudulent orders, misuse, system manipulation or conduct aimed at circumventing these terms and conditions.

8. Amendments and suspension

Without prejudice to benefits already accrued by customers through validly completed orders, Vestopazzo may amend or suspend the promotion due to force majeure, technical or organisational reasons, regulatory changes, or to prevent abuse or fraud.

Any changes:

• shall not affect orders that have already been validly completed;
• shall be communicated on the e-commerce website and via Vestopazzo’s official channels;
• shall apply exclusively to orders placed after the relevant notification.

Insofar as not expressly provided for in these terms and conditions, the general terms and conditions of sale, the returns policy and the mandatory consumer protection legislation shall apply.
